Terms of Use

Last updated: September 2026

These Terms govern your use of the SkyLink API. Our Privacy Policy is incorporated by reference.

Read §11 first. It sets out the restriction against navigational and safety-critical use, and it is the most important clause in this document.

1

Agreement

These Terms form a binding agreement between you (“Customer”, “you”) and Sergio Nicolini, a sole trader established in Italy, VAT IT04163490123, trading as SkyLink API (“SkyLink”, “we”), governing use of the SkyLink API (the “Service”).

By subscribing to a plan, generating an API key, or making any request to the Service, you accept these Terms. If you are agreeing on behalf of an organisation, you warrant that you have authority to bind it.

Your continued use of the Service constitutes acceptance of these Terms.

2

Definitions

API KeyThe licence key issued to you, presented in the x-api-key header (or your X-RapidAPI-Key where you subscribe through RapidAPI)
PlanThe subscription tier you purchase (Basic, Pro, Business)
Included RequestsThe monthly request allowance of your Plan
OverageRequests beyond the Included Requests, billed per request
Abuse CeilingA separate hard per-day cap protecting the Service (§6.3)
OutputData returned by the Service
Billing PeriodThe monthly cycle beginning on your subscription date
3

The Service

We provide programmatic access to aviation data including aircraft, airports, airlines, routes, schedules, weather, NOTAMs, charts, flight status, and — depending on Plan — historical ADS-B data and webhook notifications.

Plans, prices, and entitlements are as published at our checkout and may change under §15.

3.1 Sales channels

The Service is sold through two channels, and which one you bought through determines who bills you:

  • Direct from SkyLink. Purchased at our checkout. Payments are processed by Polar, who act as our merchant of record and are the seller of record for tax purposes. Billing disputes, invoices, and refunds are handled through Polar under §6.
  • RapidAPI marketplace. Purchased on the RapidAPI listing. RapidAPI is the merchant of record for that subscription, and RapidAPI's own terms govern billing, metering, quota, refunds, and the personal data you give them. These Terms still govern your use of the Output and everything in §5, §11 and §12.
4

Your account and API Key

  • You must provide accurate registration and billing information.
  • Your API Key is confidential. You are responsible for all activity under it, including requests made by anyone who obtains it, whether authorised or not.
  • You must not share, resell, sublicense, or publish your API Key, or embed it in a public client (a mobile app binary, browser JavaScript, or a public repository) where it can be extracted. Route calls through your own backend instead.
  • Notify us immediately at [email protected] if you suspect compromise. We will rotate the key.
  • You remain liable for Overage charges incurred through a compromised key before you notify us. The Abuse Ceiling in §6.3 limits but does not eliminate this exposure.
  • One subscription authorises one Customer. Multi-tenant resale requires a separate agreement.
5

Licence and permitted use

5.1 Grant

Subject to these Terms and payment, we grant you a non-exclusive, non-transferable, revocable, worldwide commercial licence for the term of your subscription to access the Service and to use, process, display, and incorporate the Output into your own products and services.

The FREE Trial plan is the exception: it is licensed for personal, non-commercial use only. You may not use FREE Trial access or its Output in any commercial product, service or business activity, including internal business use; for that you need a paid plan.

5.2 You may

  • Use Output in commercial applications and internal analysis.
  • Cache Output as reasonably needed for performance.
  • Display Output to your own end users within your product.

5.3 You may not

Resell, redistribute, or sublicense the raw Output as a competing data feed, or in any form that substitutes for a subscription to the Service
Bulk-extract Output to build a substantially replicating database
Share, sublicense, or expose your API Key (§4)
Circumvent, or attempt to circumvent, quotas, rate limits, plan gating, or authentication — including by using multiple accounts to exceed a Plan
Reverse engineer, decompile, or probe the Service other than under §5.5
Use the Service unlawfully, or in breach of aviation, export control, or sanctions law
Misrepresent the Output's origin, accuracy, or fitness, or remove attribution required by §5.4
Use the Service to surveil, track, harass, or profile identifiable individuals, including aircraft owners and operators

5.4 Third-party data and attribution

The Output incorporates data from third-party and public sources, which carry their own licence terms and attribution requirements. Where a source requires attribution or imposes share-alike conditions, you must comply with them. We do not warrant that your intended use complies with those third-party terms — satisfying yourself on that point is your responsibility.

5.5 Security research

We welcome good-faith vulnerability research. Do not access other customers' data, degrade the Service, or run automated load testing without written consent. Report findings to [email protected]. We will not pursue legal action for research conducted in good faith under these conditions.

6

Plans, quotas, and billing

6.1 Charges

Fees are as published at our checkout, charged monthly in advance through our merchant of record, Polar. Prices are exclusive of VAT, sales tax, and other applicable taxes, which are added at checkout based on your billing location.

Where you subscribed through RapidAPI instead, RapidAPI bills you under their terms and §6.1–6.5 do not apply to that subscription.

6.2 Included Requests and Overage

Each Plan includes a monthly allowance. Requests beyond it are billed at your Plan's per-request Overage rate and invoiced in arrears.

  • Every request that reaches the Service and is authenticated counts toward your usage, including requests that return an error caused by your input (for example 404 or 422).
  • Requests rejected for a missing or invalid API Key are not counted.
  • Usage resets at the start of each Billing Period.
  • Our metering records are the authoritative measure of usage, absent manifest error.

6.3 Abuse Ceiling

Independently of your monthly allowance, each Plan carries a hard per-day request ceiling as an anti-abuse and anti-fraud protection. It exists to bound the financial damage from a compromised or runaway API Key.

  • It is substantially higher than normal usage and is not a usage allowance.
  • Requests beyond it receive HTTP 429 until the rolling window resets.
  • The X-RateLimit-* response headers report this Abuse Ceiling, not your monthly Included Requests. They are a technical safety limit and must not be relied on to determine your remaining paid quota or your bill — consult your Polar customer portal for actual usage against your Plan.
  • We may adjust ceilings to protect the Service.

6.4 Renewal, cancellation, refunds

Subscriptions renew automatically each Billing Period until cancelled. You may cancel at any time, effective at the end of the current period; access continues until then. Accrued Overage remains payable on cancellation.

Refunds are partial, never full. The payment processing and merchant-of-record fees on each payment are spent when you pay and are not returned to us on a refund. For a subscription bought directly from us, we refund the unused part of the current Billing Period less those fees, calculated as set out in our Refund Policy, which forms part of these Terms. Overage and ended Billing Periods are not refunded. This does not limit rights you have under mandatory law, including EU/UK consumer withdrawal rights where they apply to you.

Because the Service is delivered immediately and billed by a merchant of record — Polar or RapidAPI, per §3.1 — cancellations and any statutory withdrawal right are handled by whichever of them sold you the subscription, under their terms, and a RapidAPI subscription follows RapidAPI's refund rules. Raise it with them first, and tell us if it is not resolved.

6.5 Non-payment

We may suspend the Service on failed payment after 14 days' notice, and terminate for continued non-payment under §13.

7

Availability and support

We aim for high availability but the Service is provided without a contractual uptime commitment unless a separate SLA is agreed in writing. Support targets are goals, not guarantees.

We may perform maintenance, with reasonable advance notice for planned work where practical. Third-party data source outages may temporarily affect availability.

8

Your responsibilities

You are responsible for your integration, for validating Output before relying on it, for securing your systems and API Key, and for complying with all laws applicable to your use — including data protection law in respect of any personal data contained in the Output (see Privacy Policy §3).

Where the Output contains personal data, you act as an independent controller and are responsible for your own lawful basis, notices, and data subject rights.

9

Intellectual property

We and our licensors retain all rights in the Service, its software, documentation, and the compiled databases behind it. These Terms grant only the licence in §5. You retain all rights in your own applications and data.

Feedback you provide may be used freely by us without obligation or compensation.

10

Data accuracy

Aviation data is inherently imperfect. Output is aggregated from third-party and public sources and may be incomplete, delayed, interpolated, inaccurate, or unavailable. ADS-B coverage varies by region and altitude and depends on volunteer receiver networks. Historical archives may contain gaps. Weather, NOTAM, and chart data may lag official sources.

We do not warrant the accuracy, completeness, timeliness, or availability of any Output.

11

Not for navigational or operational use

THE SERVICE IS PROVIDED FOR INFORMATIONAL, ANALYTICAL, AND PLANNING PURPOSES ONLY.

IT IS NOT CERTIFIED, APPROVED, OR SUITABLE FOR USE IN THE NAVIGATION OR OPERATION OF AN AIRCRAFT, FOR AIR TRAFFIC CONTROL OR SEPARATION, FOR SEARCH AND RESCUE, FOR FLIGHT DISPATCH OR RELEASE, FOR EMERGENCY RESPONSE, OR FOR ANY OTHER SAFETY-OF-LIFE OR SAFETY-CRITICAL PURPOSE.

DO NOT USE THE SERVICE AS A SOURCE OF OFFICIAL AERONAUTICAL INFORMATION. Weather, NOTAM, chart, and airspace data returned by the Service are not a substitute for an official pre-flight briefing from your civil aviation authority or an approved provider. Always consult official sources.

The Service is not certified under any airworthiness, avionics, or operational-approval standard, and no representation is made that it meets any such standard.

You must not integrate the Service into any avionics system, electronic flight bag function relied upon for flight safety, or any system whose failure could result in death, personal injury, or property damage.

If your product presents Output to pilots, dispatchers, or controllers, you must display an equivalent disclaimer prominently to your own end users, and you indemnify us under §14 for any failure to do so.

12

Warranty disclaimer and limitation of liability

12.1 Disclaimer

To the maximum extent permitted by law, the Service and Output are provided “AS IS” and “AS AVAILABLE”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted or error-free operation.

12.2 Exclusion of indirect loss

We are not liable for indirect, incidental, special, consequential, punitive, or exemplary damages, nor for loss of profits, revenue, data, goodwill, business interruption, or cost of substitute services, however caused and on any theory of liability, even if advised of the possibility.

12.3 Cap

Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the greater of (a) the fees you paid us in the 12 months preceding the event giving rise to the claim, and (b) USD 100.

12.4 Exclusions

Nothing limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be limited. Consumers retain all mandatory statutory rights, which these Terms do not affect.

13

Suspension and termination

We may suspend or terminate immediately where you materially breach these Terms (including §5.3 or §11), where your usage threatens the security, integrity, or availability of the Service, where required by law, or for non-payment under §6.5. Where practical and lawful, we will give notice and an opportunity to cure.

On termination: your licence ends, your API Key is revoked, accrued fees remain payable, and you must cease using and delete cached Output except where retention is legally required. §§5.4, 9, 10, 11, 12, 14, 16 and 17 survive.

14

Indemnity

You will indemnify and hold us harmless against claims, damages, losses, and reasonable costs (including legal fees) arising from your use of the Service, your breach of these Terms, your infringement of third-party rights, your breach of data protection law in respect of Output, and any claim arising from use of the Service in a safety-critical context contrary to §11.

15

Changes

We may modify the Service or these Terms. For material changes adverse to you we will give at least 30 days' notice by email or in-product, and you may cancel before they take effect. Price changes apply from your next Billing Period following notice. Continued use after the effective date is acceptance.

16

Governing law and disputes

These Terms are governed by the laws of Italy, without regard to conflict of law provisions, and together with any directly applicable European Union law. The courts of Milan, Italy have exclusive jurisdiction over any dispute, except as stated below.

Consumers. If you contract with us as a consumer, nothing here deprives you of the protection of the mandatory law of your country of residence. You may bring proceedings in your own courts, and we will bring any proceedings against you there.

17

General

  • Entire agreement. These Terms, the Refund Policy and the Privacy Policy are the entire agreement and supersede prior discussions.
  • Severability. If a provision is unenforceable, the rest stands.
  • No waiver. Failure to enforce is not a waiver.
  • Assignment. You may not assign without our written consent; we may assign to an affiliate or successor.
  • Force majeure. Neither party is liable for failure caused by events beyond reasonable control, including upstream data source outages, network failures, and acts of government.
  • No partnership. Nothing creates an agency, partnership, or joint venture.
  • Notices. To you at your registered email; to us at [email protected].
